Custom Hot Tub Seat Height 2 Feet Normal?

My pool contractor just finished my pool/hot tub combo.

I just realized he never asked me what height I wanted the hot tub benches to be, though I had submitted drawings which had the question: "Height of Hot Tub & Seat?" just after contract signing.

I must've forgot to clarify this with them. The contract says 42" overall water-line height but nothing about bench height.

Upon sitting in it (I'm 5'11"), I noticed my feet were way off the ground. Measuring bench height, it's 2' high. The water line is 39" and fixed because beyond 39" the water overflows into the pool.

That means from the height of the bench, to the water line is 15". Sitting upright, that's a couple inches below my nips.

From reading online about hot tub designs, I'm seeing overall water height guidelines to be 36" with a seat height of 16". That leaves a 20" clearance for upper body (vs my 15"), and seat height difference of 8".

My computer seat height is about 17.5" off the ground, so 16" would probably fit better since my wife is shorter.

Can anyone speak on having similar dimensions of a custom hot tub as me?
 
I am so sorry this has happened. If it is plastered there is really nothing that can be done other than take a jack hammer to it and redo it. I am sorry to say this is something that should have been caught and fixed at the dig :( When I am watching/helping with a build I tell the PO to take their plans and a tape measure out to the dig and measure everything. I also have them do it again when the steel is put in to try to keep this kind of thing from happening. I do see the note BUT am betting your PB did not even look at it again once you signed.

Debating between 16" or 24" bench height seems to be a much more difficult battle than the fact that the height of the water is 39" (rather than 42") and on the pool side, the deep end to water line is 5.5' rather than 6' as called for in the contract.
